Court tells Obama administration to state its position regarding DADT's constitutionality

The 9th Circuit has ordered the Obama administration to declare for the record whether it intends to defend the constitutionality of "don’t ask, don’t tell." The move came five days after a motions panel of the same federal appeals court effectively barred enforcement of the ban on gays and lesbians serving openly in the military.
