In opinion by Souter, 1st Circuit bars resentencing of sex offender based on need for treatment

In an opinion by retired U.S. Supreme Court Justice David Souter, the 1st Circuit has ordered a lower court to resentence a sex offender who had been sentenced to an additional 22 months so he would "have ample time" to take part in a therapy program at a nearby prison.
